5 questions drivers ask about their rights
- I left my tacho card at home. Can I still drive?
Not on work that needs a tachograph. The rules allow driving without the card only when it is lost, stolen or damaged, reported, with printouts at the start and end of the day. Forgotten at home is not one of those. - Can I refuse a run that would break my hours?
You must not drive beyond the limits, whoever asks. The operator commits an offence too if it causes or permits it. Say no, say why, and keep it in writing. - Who pays a tachograph fine?
A fixed penalty at the roadside is issued to you, the driver. The operator can be prosecuted as well, separately, for causing or permitting it. - Am I paid for waiting at the bay?
Time you are required to be there and available counts as working time, and for the minimum wage your pay across the period must cover it. Whether the contract pays it at your full rate is something to ask before you start. - What do I do if I am asked to fiddle the tacho?
Refuse. Falsifying records is a criminal offence that can mean prison, for you as well. You can report it to the DVSA in confidence, and the law protects workers who speak up.
